Hours Over 40: Comp Time Pilot Program

The 2003-2007 Agreement between the State and CSEA, includes an Over 40 Comp Time Pilot Program. This three-year pilot program allows eligible CSEA represented employees the option to earn compensatory time (Over 40 Comp Time) in lieu of overtime pay for hours worked in excess of 40 in a workweek.

The program is available to CSEA employees who are employed in overtime eligible positions grade 22 and below. Eligible employees may opt to participate in this program for a one-year period during each of the three years of the pilot. Once employees enroll, they must participate for the entire year and are not permitted to withdraw during the period for which they enrolled. Employees will need to complete separate enrollment forms each year, in order to participate.

Employees who elect to participate in the pilot program will receive overtime compensatory time at the time and one half rate for hours worked in excess of 40 in the workweek. Employees may accrue up to 120 hours of Over40 Comp Time. Thereafter, for any overtime hours worked in excess of 120 hours, employees must receive overtime pay until their Over40 Comp Time balance is reduced below 120 hours. Over40 Comp Time has no expiration date.

The enrollment period for the second year of the program is March 24, 2005 through April 6, 2005. Employees who elect to participate will be eligible to receive Over 40 Comp Time for overtime worked for the period between March 24, 2005 and April 5, 2006. The pilot program expires on April 1, 2007 unless both the State and CSEA agree to extend.
